Extradition vs Deportation, as Dr Nandipha Magudumana's case intesifies

Dr Nandipha Magudumana's urgent application to have her arrest and detention declared wrongful and unlawful's judgement will be heard on Monday the 5th of June 2023.

This is after Magudumana's counsel has argued at the high court in Bloemfontein on Thursday that her deportation was actually an extradition.

Magudumana was arrested in April 2023 in Tanzania with her boyfriend Thabo Bester, a convicted rapist and murderer who had escaped from prison, both Magudumana and Bester were returned under escort to South Africa on a chartered flight.

The counsel that was led by advocate Anton Katz SC told the court Magudumana's deportation was a disguised extradition where there was collusion between South African authorities and Tanzania.

However, the legal representative of the South African Police Services senior counsel  advacate, Neil Snellenburg has told the high court in Bloemfontein that Magudumana is omitting the context of why she was in Tanzania.

Snellenburg argued that Magudumana was illegally in Tanzania at the time of her arrest, along with Bester who is a convicted serial rapist and murderer in South Africa.

While the court was adjourned on Thursday afternoon, Magudumana will have to wait for Monday morning to hear the magistrate's judgement on the matter as proceedings are expected to commence at 10:00 am at the Bloemfontein high court.
